In a ruling handed down on Monday 20, 2021, Justice Inyang Eden Ekwo, ruled that Andy Uba was never a candidate in the Anambra gubernatorial race, having arisen through the All Progressives Congress (APC) in a fraudulently arranged primary poll.
According to Justice Ekwo, the plaintiff, George Moghalu, was successful in showing that the APC did not have a genuine primary election in which Uba claimed to have won.

The judge ordered INEC to remove Uba’s name from the election’s candidate list.
He therefore directed the APC to return the plaintiff N22,500,000 for the expression of interest and nomination forms he paid because the party failed to have a lawful primary poll.
